Selectboard Meeting Minutes

In attendance: John Alexander, Chair, David Stevens and Nancy Mallary, Selectmen, Greg Gallagher, Town Clerk Gail Brown, Louisa and Vincent Dotoli, Deborah Simpson, Bruce Wheeler, Melissa and Andrew Zebrowski, Florence Collins, Joan Bossart, Wm McGuire, Mary French, Helen Seube, Auburn Harter, John and Jan Pepper, Randi Pickle, Mary Smith, Midge Gallagher, Cindy Poplawski and Gerald Saindon.
John Alexander called the meeting to order at 6:00 PM. He explained that people would be given five minutes to talk on an issue.
Dennis Desmarais explained that the Arcadia Bridge needs a new deck. He will get four inch Hemlock from Lemar’s Mill for about $800.
Dennis will take David Stevens down to look at two bridges on Arcadia Lane. They will also look to see if a logging operation is damaging the bridges.
Dennis will hire David Perkins to truck the lumber to the site.
Tomorrow, Dennis and Darcey will start hauling sand for the winter.
The gravel is all crushed and stockpiled.
Nancy has a sample application for curb cuts. Louisa said she has talked with VLCT and the Curb Cut permit should be separate from the Zoning permit. The Selectboard has jurisdiction over town curb cuts, but not state curb cuts. It was suggested the Town Clerk make and maintain a check list for permits needed.
David reported that Scott Keyser with VT State Highway said the state did not put up stone walls and that the one in front of Mr. Collin’s camp on Old 5A belonged to the owner.
David moved and Nancy seconded for Nancy to write a letter to Mr. Collins stating the State’s policy on building walls and that the one in question belonged to him. Motion passed.
At the Health meeting John read a letter of resignation as Deputy Health Officer from Cindy Poplawski.
David moved and Nancy seconded to accept Cindy Poplawski’s resignation, with regret. Motion passed.
David moved and Nancy seconded for Nancy to write Cindy a letter. Motion passed.
Melissa Zebrowski discussed the work the Auditors are doing. They have finished the second quarter audit today. She recommended the Board ask OCSU about the Besaw Audit’s finding that they owed the town $12393. OCSU has paid $4089 of this, leaving a balance of $8304.
After some discussion, Nancy moved and David seconded to ask the Auditors to write OCSU about the Besaw finding and copy the Westmore School Board. Motion Passed.
Nancy was asked to be the coordinator from the Board with the Auditors and the Treasurer to get the Besaw numbers into the Town’s financials.
Nancy moved and David seconded to approve the 8/22/2006 Minutes as written. Motion passed.
Greg reported that Claude Desmarais had picked up two stray dogs from the Willoughvale.
Nancy moved and David seconded to have John call the State about procedures with stray dogs and work with Greg on steps to be taken. Motion passed.
Jeremy LeBlanc reported on the milfoil progress. He has finished picking in front of the North Beach and found another large bed by Grey Rock.
Jeremy will call Ethan Swift for help with his final report for the next meeting.
Bill McGuire commended Jeremy and his crew for their good work.
Deborah Simpson read a letter about Zoning Bylaw violations on the Hayes lake front property and lack of enforcement. [See attached with pictures]
John read a letter from Andrew Berley about his inspection of the same property. [Attached]
John will forward his letter to the Planning Commission.
Louisa said that Andy had to inspect the alleged by law violation and then any appeal would go to the Zoning Board. She also said that Andy is very new and is doing a very good job. The Town has had four Zoning Administrators in recent years.
Nancy moved and David seconded to enter Deborah’s letter and pictures into the minutes and forward the letter to the Zoning Board. Motion passed.
Bill McGuire read his letter on the same topic and asked that it be entered into the minutes.
Louisa will set up a public hearing on the issue as soon as she receives a written complaint form the Zoning Administrator.
David mentioned that he was surprised to see no preventive measures taken on that property.
Randi started to read a newspaper article on Memphremagog’s premature aging, but John ruled the information not pertinent to the issue at hand and therefore out of order.
As Randi insisted it was pertinent, she continued.
Nancy moved and David seconded to recess the meeting for five minutes. Motion passed.
The meeting resumed at 7:53 PM.
John read a Statute on keeping order.
Gail Brown, Lister, brought in a second "Errors and Omissions" report dated 8/29/2006 which asked to make adjustments to two properties.
Nancy moved and David seconded to accept the Lister recommended "Errors and Omissions Certificate". Motion passed.
Greg said he received a call from Gary Leach who said he would have his proposal with cost estimates for the next meeting. He will ask if Gary can get it earlier so a USDA grant can be applied for.
John explained that Barton Electric has contracted out the big pine tree cutting and the contractor will do the job when they are in the area, whenever that is.
Gerald reviewed his work on the Municipal Building basement.
Nancy moved and David seconded to have Nancy write Bill May a letter asking for advice on how to handle any construction negligence that is found. Motion passed.
After Gerald explained the poor condition of North Beach fence issue, Nancy moved to tear down the fence as needed. David wanted to look into earlier stipulations.
Auburn Harter asked about the status of the cross off the North Beach. John explained that it was only temporary and the man who installed as a memorial to his brother had said it would come down this Fall.
Nancy moved and David seconded to have John nominate Arthur and Wayne French for the Healthy Aging Award.
Nancy moved and David seconded to forward the Paul Hannan proposal to research Ancient Roads to the Planning Board. Motion passed.
David moved and Nancy seconded to reappoint Louisa Dotoli as the Town’s representative to NVDA. Motion passed.
David reported a complaint from Peter Chase of water running onto his property from a town culvert on Peene Hill.
John moved and David seconded for David to talk with Scott Keyser and get a recommendation on the culvert and water problem at Peter Chase. Motion passed.
Gerald asked what to do about the potential problem with the up coming fishing derby and milfoil and Zebra Mussels.
Nancy moved and David seconded to ask Jeremy LeBlanc if he or one of his crew could watch for Zebra Mussels and Milfoil on boats launching 9/9 and 10 from 4 AM-9 AM each day at $15 per hour. Motion passed.
Nancy moved and David seconded to approve and authorize to pay Select Orders #18 and Select Payroll #18. Motion Passed.
Nancy moved and David seconded to accept Bill Perkins resignation from the Planning Commission upon receipt of his letter. Motion passed.
Nancy moved and David seconded, based on the recommendation of the Planning Commission, to appoint Bill Perkins temporary Zoning Administrator in Andrew Berley’s absence. Motion passed.
John commended the Planning Board for all their hard work.
Nancy moved and David seconded to adjourn the meeting at 9:16 PM. Motion passed.
