Selectboard Meeting Minutes

In attendance: John Alexander, Chair, David Stevens and Nancy Mallary, Selectmen, Greg Gallagher, Town Clerk, Dennis Desmarais, Dick Simpson, Eleanor Averill, Charles Averill, Gary Seslar, Dr. Sturtevant,Vince and Louisa Dotoli, Lee and Carmen Anderson, Rick Mallary, Annalei Babson, Paul Wasklewicz, Jeremy LeBlanc and Gerald Saindon.

John Alexander called the meeting to order at 6:00 PM.

John explained the procedure for orderly citizen input into the meeting.

Dennis reported that he has completed replacing the deck on the first Arcadia Road Bridge. He has talked with the logger up there who said he would not drag logs across the bridges anymore.

All the winter sand has been put up. He will be changing a culvert on the Long Pond Road this week. He will also be cutting brush. He will grade after the rain.

Nancy passed out copies of the draft "Curb Cut" regulations and application for Dennis and the board to review.

John introduced the Road Reclassification agenda item. There have been petitions asking to reclassify Old Cottage Lane and Tower Lane roads from Class IV to Class III. John shared his recently discovered legal procedures for this process. Every property owner and the Planning Commission on any road being considered for reclassification needs to be notified by certified letter of a Public Hearing on the issue.

Vince Dotoli suggested printing descriptions of Class III and IV roads in the notices.

John said the notices should include a statement that the property owners may be responsible for any costs incurred. Gary Seslar said if the notification will mention costs to owners, a cost estimate should be included.

David said that Scott Keyser, VT Highway engineer, said Old Cottage Lane would need minor ditching and some gravel and may need to be widened, a culvert replaced and move a phone pole. He said Class III roads should be fourteen feet wide. Other upgrades would depend on the traffic count.

Dennis asked if the Town had a three rod right of way on Old Cottage Lane.

Annalei Babson asked what Scott Keyser said would be needed on Tower Lane. At that point Nancy recussed herself from the meeting.

David said it would need:

The ditch at the top would need to be more defined;

It would need about one foot of gravel where it comes into Cole Road;

Other areas will need more gravel;

Where water runs more that 200 feet it will need to cross under the road and

One of the culverts will need to be lengthened.

John will write down what will be needed, who will do it and what it will cost.

Annalei will give Greg a list of owners along Tower Lane.

Nancy returned to the meeting.

Nancy moved and David seconded to mail certified letters to property owners on Old Cottage Lane and Tower Lane by Sept 30 notifying them of a Public hearing on their Road reclassification and place an ad in the Chronicle by Oct 18 for a Public Hearing on Oct 31. The Selectboard will have a site inspection at Old Cottage Lane Oct 31 at 4:00 PM and Tower Lane at 5:00 PM. Then a Public Hearing will be held at the Selectboard meeting at 6:00 PM. The board will write the letter and the ad and Greg will do the labels and mailing. Motion passed.

Carmen Anderson reported in as Deputy Health Officer. She is already sworn in and has her certificate from the state as Deputy Health Office and is willing to continue in that capacity. Nancy moved and David seconded to ask Greg to place an ad in the Chronicle for an opening as Deputy Health Officer. Motion passed.

Nancy brought in a Westmore draft "Stray Dog Policy" for the board to review. Adoption was tabled until the next meeting.

Jeremy LeBlanc gave his final Milfoil Report. He pulled 623.5 barrels of milfoil this summer. He reviewed his final Grant report to the State.

Nancy moved and David seconded to ask Greg to send the Grant report to Ethan Swift for his review and comment so the board can sign it at the next meeting. Motion passed.

Nancy moved and David seconded to accept the Minutes of 9/5/2006 as written. Motion passed.

Bill Perkins letter of resignation from the Westmore Zoning Board was received. His resignation had already been accepted subject to his letter.

Nancy moved and David seconded to accept the Listers recommended "Errors and Omissions Certificate" lowering the appraised value of land owned by the Town of Charleston. Motion passed.

Louisa said ZBA has received appeals from citizens on clearing close to the Lake. The Public Hearing will be Oct. 13.

John commented on the huge amount of time put in by Planning and Zoning.

Greg presented a letter from Tim Hayes and Chris Anderson owners of one of the criticized property owners. The letter responded to accusations made against them at the last meeting. (see attached) The letter was copied to Louisa.

John has sent a letter to Dale Perron, District Manager of VTRAN, regarding the Selectboard support of a Westmore Association request for a lower speed limit and blinking lights by the Willoughby boat launch. Mr. Perron has forwarded it to the State Highway Safety Department.

Gerald reported that the North Beach fence was down. He needs the towns backhoe to move the rocks.

The board said to leave the toilet tanks in until November and shut the power off anytime.

Paul Wasklewicz and Dick Simpson commended Gerald on his work at the North Beach this year.

Nancy reported that she, Greg, and Annalei Babson and Gerald met with Gary Leach, Leach Engineering, and Mark Kaprowski, USDA regarding the plans and financing of renovating the water system and installing backup generators for the town buildings and Fellowship Hall on Hinton Hill. Gary brought preliminary plans and will submit new plans. Mark said there would be USDA grant money for this project as it qualifies as an emergency center.

Nancy moved and David seconded for John to write to Al Brusard to ask him to come to the next meeting to explain his request for an underground electrical entrance which would run under Old Cottage Lane. Motion passed.

David moved and Nancy seconded to ask Gerald to ask Ellis, Chipper, Merchant to take down the big pine tree by the old office and bill the Town of Barton. Motion passed.

David moved and John seconded for Nancy to work with Greg to find any funds available for Schoolhouse maintenance.

The board signed letters to Jim Collins regarding a stone wall in front of his house and Cindy Poplawski accepting her resignation as Deputy Health Officer.

They also signed a letter to Bill May regarding statute of limitations on school house.

Nancy moved and David seconded to approve and authorize to pay Select Orders #19 and Select Payroll #19. Motion Passed.

The board reviewed correspondence.

At 9:12 PM, David moved and Nancy seconded to go into Executive Session to discuss personnel issues. Motion passed.

At 9:20, Nancy moved and David seconded to come out of Executive Session. Motion passed.

Nancy moved and John seconded to invite Larry Phipps to the next meeting.

Nancy moved and David seconded to adjourn the meeting at 9:24 PM. Motion passed.
